Abstract

In order to increase the share of energy from renewable sources to 2030, dir. 2001/2018/EU - now transposed with d.lgs. n. 199/2021 - has foreseen a new legal entity, the renewable energy community, whose objective is to provide not only environmental, but also economic or social benefits at community level, its shareholders or members or the local areas in which it operates. The aim of this paper is to make some general considerations on this new subject and in particular on European policies, as well as on the constitutional principles which form the legal basis for it
