The paper starts from an examination of the provisions contained in the 2021 market and competition bill, and, after highlighting the many problems of some of its provisions, goes on to analyze those same provisions as amended during the approval of the text of the enabling law on the subject, placing themselves in the perspective of appreciating the extent of the impact that, on the relative parliamentary debate, was exercised by those who immediately showed themselves absolutely critical of the legislative text in question, and specifically of its original "derive privatization”, also because it clashes with the results of the now dated referendum on the privatization of public services. All in the awareness that those mentioned here are, still today, topics of some relevance and of great interest, as demonstrated by the discussion within the Executive in view of the implementation of the delegation received, and even more so by the text of the decree in the meantime written and circulated.
